{"id":4593,"date":"2019-06-15T19:07:59","date_gmt":"2019-06-15T19:07:59","guid":{"rendered":"https:\/\/c4n6.com\/site\/?p=4593"},"modified":"2019-11-13T19:10:11","modified_gmt":"2019-11-13T19:10:11","slug":"nis-defects","status":"publish","type":"post","link":"https:\/\/c4n6.com\/site\/nis-defects\/","title":{"rendered":"NIS Defects"},"content":{"rendered":"<p>In this June edition of our HUD-REAC newsletter, I\u2019d like to discuss NIS (Not Industry Standard) defects.<\/p>\n<ul>\n<li>In 2016, HUD enacted the NIS rule: \u201cAll repairs made to address UPCS deficiencies in preparation for a REAC inspection shall be made in a good and workmanlike manner with materials that are suitable for the purpose and free from defects.\u201d\n<p>\u201cGood and workmanlike manner\u201d is defined by HUD as:<\/p>\n<ol>\n<li>Ensuring that the component, as repaired, performs its intended function\/purpose<\/li>\n<li>Finishing the repair in a manner reasonably compatible with design and quality of the original and adjoining decorative materials.<\/li>\n<li>Ensure proper maintenance of each inspectable item based on industry standards<\/li>\n<\/ol>\n<p>Put succinctly, fix deficiencies the right way and don\u2019t hide them.<\/li>\n<li>This rule effectively wiped out all objectivity in the inspection process. HUD has, for the last 3 years, held sessions with inspectors attempting to clearly define what they perceive a NIS defect is but there is still mass confusion.<\/li>\n<li>Because of the continued confusion amongst inspectors, on May 28, 2019, HUD delivered to inspectors the first\u00a0<a href=\"https:\/\/c4n6.com\/site\/wp-content\/uploads\/2019\/06\/NIS-Final-Decision-May-2019.pptx\">\u201cNIS Final Decision\u201d PowerPoint<\/a>\u00a0where a Quality Assurance committee reviewed many reported NIS findings and made a \u2018final decision\u2019 of whether it truly is a NIS defect.<\/li>\n<li>Unfortunately, there is much in this PowerPoint which contradicts the NIS definition listed above but it does provide some ammunition in appealing NIS findings and perhaps some clarity to your maintenance staff on what is considered an Industry Standard repair or not.<\/li>\n<\/ul>\n<p>Comments\/explanations are added to each slide of the powerpoint to help with understanding.\u00a0<a href=\"https:\/\/c4n6.com\/site\/wp-content\/uploads\/2019\/06\/NIS-Final-Decision-May-2019.pptx\">NIS Final Decision May 2019<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In this June edition of our HUD-REAC newsletter, I\u2019d like to discuss NIS (Not Industry Standard) defects.
