we made up a deficiency for it!<br \/>\n<span style=\"color:#FF0000\"><strong><u>UPCS:<\/u><\/strong>&nbsp;<\/span><br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055499\" height=\"66\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/416594a0-9d21-80a5-f5c8-e32c90b49654.png\" style=\"border: 0px  ; width: 600px; height: 66px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>It&rsquo;s the complete opposite for the NSPIRE protocol!<br \/>\n<span style=\"color:#FF0000\"><strong><u>NSPIRE &ndash; The Triple I Rule:<\/u><\/strong><\/span><br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055495\" height=\"35\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/21444986-772e-5958-3005-b46ef7c25359.png\" style=\"border: 0px  ; width: 600px; height: 35px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>While I agree that the NSPIRE Inspector Protocol has some conflicting information in it, I believe HUD&rsquo;s intent on this rule is clear.&nbsp; I am going to explain this in its entirety so that it will assist you in appealing.<br \/>\n&nbsp;<br \/>\n<strong><u>No Access to a Common Area (e.g. janitor closet, electric room, etc.):<\/u><\/strong><br \/>\nThings happen.&nbsp; You lost the key or the key broke off in the lock&hellip;or maybe you never had a key!<\/p>\n<p>The Protocol states:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055501\" height=\"103\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/37b8276c-680f-6160-d295-bfecdfeade6d.png\" style=\"border: 0px  ; width: 600px; height: 103px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>\nYou <strong><u>CANNOT<\/u><\/strong>:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055506\" height=\"40\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/bf5732f9-3cd1-c59c-f6ff-cf2acb1ee2a1.png\" style=\"border: 0px  ; width: 600px; height: 40px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>\nBut if you cannot provide access to the Common Area for inspection, the inspector has clear instructions:<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055507\" height=\"35\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/be4885f2-9d89-056e-9781-a8897bd0e571.png\" style=\"border: 0px  ; width: 600px; height: 35px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>What does this mean to you?<br \/>\nHUD may follow up with you via phone or in person to see what you&rsquo;re hiding  Seriously, 99% of the time they will let it go &ndash; unless it becomes a persistent problem, of course.<\/p>\n<p><strong><u>Elevator Machinery Rooms have specific, crystal-clear rules:<\/u><\/strong><br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055498\" height=\"81\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/163052cc-00a0-35c9-860d-0178dabcf0a8.png\" style=\"border: 0px  ; width: 600px; height: 81px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>\n<strong><u>Never Inspected:<\/u><\/strong><br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055497\" height=\"69\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/dee378cc-2aff-e585-1411-48ef3e65db51.png\" style=\"border: 0px  ; width: 600px; height: 204px; margin: 0px;\" width=\"600\" \/><\/p>\n<p><strong><u>UNITS &ndash; Inspector Requirements:<\/u><\/strong><br \/>\nI have been hearing that some inspectors do not physically test inspectable items but rather force the person escorting them to do it.&nbsp;<span style=\"color:#FF0000\"> <strong>THIS IS AGAINST PROTOCOL!<\/strong><\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055492\" height=\"25\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/c61c42ed-7852-5de9-8eda-4cab07842c3d.png\" style=\"border: 0px  ; width: 600px; height: 25px; margin: 0px;\" width=\"600\" \/><br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055491\" height=\"33\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/c2365aa1-0c6c-1d14-44ad-23e83204f99b.png\" style=\"border: 0px  ; width: 600px; height: 33px; margin: 0px;\" width=\"600\" \/><br \/>\n&nbsp;<br \/>\n<strong><u>Bottom Line:<\/u><\/strong><br \/>\nWhile the property escort is required to provide access to all inspectable items, sometimes it&rsquo;s just not possible.&nbsp;<br \/>\nExample 1: The only bedroom window is blocked by resident property:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055504\" height=\"317\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/e788af2b-0362-dc80-ba9c-73095f8c58b7.png\" style=\"border: 0px  ; width: 535px; height: 317px; margin: 0px;\" width=\"535\" \/><\/p>\n<p>The inspector is unable to test the operation of the window or, in many cases, cannot even reach the window to inspect the components (operation, screen, frame, etc).<br \/>\nThe NSPIRE Protocol is clear (The Triple I Rule):<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055495\" height=\"35\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/21444986-772e-5958-3005-b46ef7c25359.png\" style=\"border: 0px  ; width: 600px; height: 35px; margin: 0px;\" width=\"600\" \/><\/p>\n<p><span style=\"color:#FF0000\"><strong><u>THIS MEANS THE INSPECTOR OBSERVES WHAT THEY CAN AND MOVES ON!!!<\/u><\/strong><\/span><br \/>\n&nbsp;<br \/>\nSide Note: Due to politics, this is <u>NOT<\/u> an obstructed rescue opening.&nbsp; It is, however,<span style=\"color:#FF0000\"> <strong>a fire code violation and you&rsquo;re still liable.<\/strong><\/span>&nbsp; <a href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PIH\/documents\/NSPIRE-Standard-Egress_20230811.pdf\">NSPIRE Egress Standard<\/a>:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055490\" height=\"27\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/cdd2f81c-287d-2e9f-239b-754156c7aab1.png\" style=\"border: 0px  ; width: 600px; height: 27px; margin: 0px;\" width=\"600\" \/><br \/>\nExample 2: The water heater is located under the kitchen countertop and isn&rsquo;t accessible.<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055505\" height=\"475\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/1ebf639b-228b-c058-0d1b-8a50ce3c837d.png\" style=\"border: 0px  ; width: 597px; height: 475px; margin: 0px;\" width=\"597\" \/><\/p>\n<p>\nIn 2013, I brought up this issue, and it was addressed in HUD&rsquo;s QA Question of the Month:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055496\" height=\"69\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/c120b508-fff6-1447-a5c3-3be30f2a43f8.png\" style=\"border: 0px  ; width: 600px; height: 69px; margin: 0px;\" width=\"600\" \/><br \/>\nUnder UPCS, it was crystal clear:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055494\" height=\"65\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/47a7ca2b-9041-27a4-2ee4-af3f37ff8540.png\" style=\"border: 0px  ; width: 600px; height: 65px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>Under NSPIRE, it&rsquo;s less clear HOWEVER the Triple I Rule is absolutely applicable!<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055489\" height=\"41\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/5ae8598b-b39a-0096-3a32-c0720938be13.png\" style=\"border: 0px  ; width: 600px; height: 41px; margin: 0px;\" width=\"600\" \/><\/p>\n<p>So what if you say you won&rsquo;t provide access?&nbsp; The Triple I Rule applies:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3055495\" height=\"35\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/21444986-772e-5958-3005-b46ef7c25359.png\" style=\"border: 0px  ; width: 600px; height: 35px; margin: 0px;\" width=\"600\" \/><br \/>\n&nbsp;<br \/>\nSome inspectors are used to the old rule under UPCS and are citing (sometimes multiple) non-existant deficiencies because they do not agree with the rules or are being told to do so by the HUD Vendors.<\/p>\n<p>You can appeal these &ldquo;deficiencies&rdquo;
