<\/strong><br \/>\n<strong>it is currently undergoing final clearance before it&rsquo;s released***<\/strong><br \/>\n&nbsp;<br \/>\n<strong><u>THE STATE OF APPEALS<\/u><\/strong><br \/>\n&nbsp;<br \/>\nUnfortunately&hellip;I have bad news.&nbsp; With so many seasoned employees leaving HUD recently, we are left with a bare bones crew where at least a few HUD Reviewers clearly have zero experience with construction or the NSPIRE Protocol itself.<br \/>\n<em>Even with the absolute best constructed appeal, HUD is rejecting them left and right.<\/em><br \/>\nWorse, HUD has the ability to reverse an incorrect decision&hellip;but have yet to do so.<br \/>\nLet me show you some examples&hellip;<br \/>\n&nbsp;<br \/>\nThis was cited during the NSPIRE inspection as &ldquo;Outlet\/Switch is damaged&rdquo; with is a Life-Threatening Health &amp; Safety &ndash; the highest scoring deficiency.<\/p>\n<ol>\n<li>This is not an outlet receptacle.<\/li>\n<li>It&rsquo;s low voltage and is exempt from the NSPIRE Standards<\/li>\n<li>A letter from an electrician was provided, even though it is clearly not an outlet receptacle.<\/li>\n<\/ol>\n<p><img loading=\"lazy\" decoding=\"async\" data-file-id=\"3045855\" height=\"257\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/bd09baeb-4c8f-e7e0-3fd0-37756697453d.png\" style=\"border: 0px  ; width: 600px; height: 257px; margin: 0px;\" width=\"600\" \/><br \/>\n&nbsp;<br \/>\nThis was cited during the NSPIRE inspection under the:<\/p>\n<ol>\n<li><strong>Inside inspectable area<\/strong> (which literally means inside the building &ndash; common areas)<\/li>\n<li>Cited as &ldquo;<strong>Interior Wall has loose or detached surface covering.<\/strong>&rdquo;<\/li>\n<li>It was cited in the totally wrong building<\/li>\n<li>The inspector&rsquo;s comments stated, &ldquo;roofing damage&rdquo; although cited as Interior Wall<\/li>\n<li>Could be a bad photo, but I&rsquo;m not seeing roof damage here.<\/li>\n<\/ol>\n<p><img loading=\"lazy\" decoding=\"async\" data-file-id=\"3045856\" height=\"252\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/9eeb7b85-4bff-cd19-453c-9287c9d0eede.png\" style=\"border: 0px  ; width: 600px; height: 252px; margin: 0px;\" width=\"600\" \/><br \/>\n&nbsp;<br \/>\nI have a lot more examples, but you get my point.&nbsp;<br \/>\nIt doesn&rsquo;t seem to matter how obviously incorrect something was cited, nor does it seem to matter if you get a letter from a licensed professional &ndash; just about everything seems to be getting rejected.<br \/>\n&nbsp;<br \/>\n<strong><u>WHAT CAN YOU DO IF YOU HAVE A REJECTED APPEAL OR BAD INSPECTION?<\/u><\/strong><br \/>\n&nbsp;<\/p>\n<ol>\n<li>Email <a href=\"mailto:NSPIRE@HUD.gov\">NSPIRE@HUD.gov<\/a> and <a href=\"mailto:NSPIREREGULATIONS@HUD.gov\">NSPIREREGULATIONS@HUD.gov<\/a> and explain the situation.<\/li>\n<li>Email your Senators because there is <strong>still no nationally recognized training program for the inspectors.<\/strong><\/li>\n<li>During the REAC inspection, if you see clear protocol violations&hellip;you should seriously consider stopping the inspection.&nbsp;<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\nI know this can be scary&hellip;but with very little chance at a successful appeal, what other option do you have?!<\/p>\n<ol style=\"list-style-type:lower-alpha;\">\n<li>STAY PROFESSIONAL!<\/li>\n<li>Call HUD&rsquo;s Technical Assistance Center (TAC) at 888-245-4860 and tell them what&rsquo;s going on during your inspection.&nbsp; <strong>You NEED a paper trail here (i.e. get a TAC number).<\/strong><\/li>\n<li>Call your Account Executive (AE) at your local HUD office.<\/li>\n<li>Do realize that by cancelling the inspection, there is a chance that HUD&rsquo;s Federal Inspectors could inspect your property instead of a contract inspector.&nbsp; But also realize you were going to fail your inspection with bogus deficiencies being cited anyway with little chance at a successful appeal&hellip;so can it be any worse?<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\n<strong><u>Scheduling Protocol&hellip;or lack therof<\/u><\/strong><br \/>\nThis is the last Scheduling Protocol by HUD: <a href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PIH\/documents\/COVID19InspectorProtocolNotice2021-01.pdf\">Inspector Notice 2021-01<\/a> which <strong>states nothing about whether a 2<sup>nd<\/sup> inspection date can be offered nor whether the inspection date can be negotiated.<\/strong><br \/>\nThe ONLY mention of Scheduling Protocol in the Federal Register for NSPIRE is in <a href=\"https:\/\/www.ecfr.gov\/current\/title-24\/section-5.705\">24 CFR 5.705<\/a><br \/>\n&nbsp;<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3045857\" height=\"243\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/f4b35257-f10b-03e9-6f16-1336df96aba8.png\" style=\"border: 0px  ; width: 600px; height: 243px; margin: 0px;\" width=\"600\" \/><br \/>\nThis is the ONLY mention of Scheduling Protocol in the NSPIRE Administrative Final Rule:<br \/>\n<img loading=\"lazy\" decoding=\"async\" data-file-id=\"3045858\" height=\"76\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/28fc8bb3-0b30-a2b3-23e8-7e1d649efe0a.png\" style=\"border: 0px  ; width: 600px; height: 76px; margin: 0px;\" width=\"600\" \/><\/p>\n<ul>\n<li><strong>Under the NSPIRE Protocol, there is nothing in writing stating a negotiated inspection date is prohibited!&nbsp; <\/strong><\/li>\n<li><strong>There is no guidance or repercussion in writing for cancelling a currently on-going inspection!<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<br \/>\n<strong>NSPIRE has been live since 2023.&nbsp; Inspections throughout the nation are NOT consistent, accurate, nor objective &ndash; which are the exact opposite of NSPIRE&rsquo;s core goals!<\/strong><\/p>\n<ul style=\"list-style-type:circle;\">\n<li><strong>To date, there is still no national, mandatory training program for inspectors.<\/strong><\/li>\n<li><strong>There is no official Scheduling Protocol.<\/strong><\/li>\n<li><strong>And now with blatantly obvious appeals getting rejected, it&rsquo;s time for you to speak up!<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<br \/>\n<strong><u>Contact me!<\/u><\/strong><br \/>\nFor all training, Pre-REAC inspections, or appeal consultations, please reach out to me at <a href=\"mailto:kmarkan@c4n6.com\">kmarkan@c4n6.com<\/a><br \/>\n&nbsp;<br \/>\n<strong><u>Resources<\/u><\/strong><br \/>\nHUD has PDFs (videos are currently down) on how to appeal and how to close out H&amp;S deficiencies here:<br \/>\n<a href=\"https:\/\/www.hud.gov\/reac\/nspire-toolkit\">NSPIRE Toolkit<\/a><br \/>\n&nbsp;<br \/>\n**Remember, if you will be appealing something, your &ldquo;defect mitigation in 24 hours&rdquo;
