{"id":6359,"date":"2024-04-30T22:15:16","date_gmt":"2024-04-30T22:15:16","guid":{"rendered":"https:\/\/c4n6.com\/site\/?post_type=blog_post&#038;p=6359"},"modified":"2024-04-30T23:01:43","modified_gmt":"2024-04-30T23:01:43","slug":"hud-nspire-april-newsletter-nspire-standard-flammable-and-combustible-item","status":"publish","type":"blog_post","link":"https:\/\/c4n6.com\/site\/blog-post\/hud-nspire-april-newsletter-nspire-standard-flammable-and-combustible-item\/","title":{"rendered":"HUD NSPIRE April Newsletter: NSPIRE STANDARD: Flammable And Combustible Item"},"content":{"rendered":"<h3 class=\"null\" style=\"text-align: center;\"><span style=\"font-size: 18px;\"><strong><u>NSPIRE TRAINING ANNOUNCEMENT!<\/u><\/strong><br \/>\n<strong>\u2018HUD-NSPIRE Demystified: A Deep Dive into the New Inspection Process\u2019<\/strong><\/p>\n<p><strong>The next full trainings will begin in May \u2013 register here: <\/strong><br \/>\n<a href=\"https:\/\/c4n6.com\/site\/hud-pre-reac-inspections\/hudreacwebinars\/\"><strong>NSPIRE Demystified Training<\/strong><\/a><\/p>\n<p><strong>Click here to check out free, downloadable <\/strong><a href=\"https:\/\/c4n6.com\/site\/hud-pre-reac-inspections\/reac-resources\/\"><strong>REAC Resources<\/strong><\/a><\/span><\/h3>\n<p>April\u2019s Newsletter reviews the only deficiency under the <a href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PIH\/documents\/NSPIRE-Standard-Flammable-and-Combustible-Item_20230620.pdf\">Flammable and Combustible Item Standard<\/a>. \u00a0\u00a0This is quickly becoming the number one <strong><em>misrecorded<\/em><\/strong> deficiency on NSPIRE inspections and honestly has me pretty fired up because it is scored at the highest-scoring, Life-Threatening H&amp;S level!<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 107px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/33497d28-64be-7ddc-96f7-84f703aa05d5.png\" width=\"600\" height=\"107\" border=\"0\" data-file-id=\"2928025\" \/><br \/>\n<strong>Why did HUD use the verbiage, \u201can appliance that provides <em>heat for thermal comfort<\/em>?\u201d<\/strong><br \/>\nBecause HUD did <strong><u>NOT<\/u><\/strong> want inspectors citing paper\/plastic\/wood in or on stoves!!!<br \/>\nWhat do stoves provide heat for?\u00a0 Cooking!!!!<br \/>\nWe all know some residents use their stoves to heat their unit although this is against fire code and common sense.\u00a0 HUD says in 2 different Standards that stoves are NOT considered an appliance that \u201cprovides heat for thermal comfort!\u201d<br \/>\nHVAC Standard:<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 132px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/2f43ac94-5dc2-6d2f-c731-406347a8cd55.png\" alt=\"A yellow and black textDescription automatically generated\" width=\"600\" height=\"132\" border=\"0\" data-file-id=\"2928021\" \/><br \/>\nCooking Appliance Standard:<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 49px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/4c81de93-bf06-ec37-85c8-4c0c714813a3.png\" width=\"600\" height=\"49\" border=\"0\" data-file-id=\"2928017\" \/><\/p>\n<p>In every single Standard, if something else is wrong with an inspectable item \u2013 HUD makes it clear which Standard that should be cited in.\u00a0 This is <u>NOT<\/u> the case for flammable\/combustibles for stoves where HUD only states to make sure nothing will burn or melt on the burners or inside the oven.<\/p>\n<p>This should not be shocking to anyone.\u00a0 Under UPCS (the old protocol), if we found anything that could burn on top of or inside stoves \u2013 we were directed to cite it as \u201cHealth &amp; Safety: Hazards: Other\u201d which was a NON-SCORING section!<br \/>\nNSPIRE does not have a non-scoring section which is why HUD directs inspectors only to cite appliances that <em>provide heat for thermal comfort<\/em>.<\/p>\n<p><strong>What if the inspector insists on citing the storage in or on top of the stove as a deficiency? <\/strong><br \/>\nAsk them to cite it under the Cooking Appliance Standard \u2013 the highest-scoring deficiency under that Standard is Severe H&amp;S.\u00a0 Severe Health &amp; Safeties are a 24-hour required correction on scored properties and a 30-day correction timeframe for Voucher properties. This works out to be 0.6 per unit on a 100-unit property.\u00a0 <strong><em><u>This is A LOT better than 2.40 points per unit on a 100-unit property!!!! <\/u><\/em><\/strong><\/p>\n<p>I know many of you try to speak as little as possible to the inspector, however this is an instance where you need to speak up!\u00a0 It is difficult to convince the reviewers at HUD to permit an appeal on storing paper and plastic in the oven when everyone knows you shouldn\u2019t do it.<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 184px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/d5c24383-d97c-9119-6a79-18536660d0bf.png\" alt=\"A collage of a stoveDescription automatically generated\" width=\"600\" height=\"184\" border=\"0\" data-file-id=\"2928041\" \/><\/p>\n<p><strong>Why is there confusion?<\/strong><br \/>\nBecause HUD listed stoves and ovens as potential \u201clocations\u201d under this Standard.\u00a0 So, while the Deficiency and the Criteria match perfectly and seem crystal clear\u2026HUD throws this in to confuse everyone:<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 88px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/e0e353a0-32f0-3824-cdf1-fee437f27f9d.png\" alt=\"A close-up of a white backgroundDescription automatically generated\" width=\"600\" height=\"88\" border=\"0\" data-file-id=\"2928033\" \/><br \/>\nThis is not the only Standard where \u201cLocations\u201d make little to no sense or are the complete opposite of what the deficiencies within the Standards direct inspectors to actually cite as deficient.<br \/>\nAdditionally, HUD still has not provided a thorough training for the inspectors and many of the Standards raise more questions than provide answers.<\/p>\n<p><strong>What are some appliances that provide heat for thermal comfort?<\/strong><\/p>\n<ul>\n<li>Forced air furnaces<\/li>\n<li>Electric heaters (<strong><em>including portable space heaters<\/em><\/strong>)<\/li>\n<li>Gas fired wall heaters<\/li>\n<li>Hydronic (radiant) heaters (typically don\u2019t get hot enough to burn \u2013 need clearance for air circulation only)<\/li>\n<li>Heat pumps (generally no clearances for indoor air handler but outside needs 24 inch clearance JUST for maximum airflow)<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 219px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/8ef602ea-6d1b-6282-2e12-552aea383dbc.png\" alt=\"A bag on a trash canDescription automatically generated\" width=\"600\" height=\"219\" border=\"0\" data-file-id=\"2928037\" \/><\/p>\n<p><strong>3 feet\u2026which direction?!<\/strong><br \/>\nThere are clearances for many reasons including working space, ventilation, and fire prevention.\u00a0 <em>HUD is focusing on preventing fires in this Standard.<\/em><br \/>\nRequired clearances depend on the heating system you use and your local fire code!\u00a0 Some clearances are 12 inches, and some are 2 feet.\u00a0 HUD, being federal, went with the strictest code which, for most of you, makes for an easier appeal.<br \/>\n<em><u>ANY<\/u><\/em> time you can get the Fire Marshall to state, in writing, that something is acceptable per fire code \u2013 it\u2019s a slam dunk appeal.\u00a0 Fire trumps HUD 100% of the time.<br \/>\nAlso look at the manufacturer\u2019s instructions!\u00a0 For instance, on many electric baseboard heaters, clearance in front is 3 feet\u2026but it\u2019s 6 inches on the sides and 12 inches above!<\/p>\n<p><strong>3 feet clearance for fuel-fired water heaters?<\/strong><br \/>\nHonestly \u2013 I\u2019m not sure where HUD got this guidance.\u00a0 The general rule is a 12-18 inch clearance for flammable and combustible items stored near fuel-fired water heaters.\u00a0 If anyone has a stricter code than this, I would love to see it!<br \/>\nCheck your manufacturer instructions for clearance distance and\/or your Fire Marshall.\u00a0 It\u2019s worth the effort appealing this high-scoring item!<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial; width: 600px; height: 38px; margin: 0px;\" src=\"https:\/\/mcusercontent.com\/09ba5c1c1015b2f3c02e52ae8\/images\/2a8fae3a-fb3c-5483-299d-750487a487ef.png\" width=\"600\" height=\"38\" border=\"0\" data-file-id=\"2928029\" \/><br \/>\nThis includes gas-fired equipment like motorcycles, lawn mowers, etc.<br \/>\n<img loading=\"lazy\" decoding=\"async\" style=\"border: 0px initial;
